Terms of using our Services

Free Estimates – Computer Equipment Diagnostics 

Equipment dropped off at our premise will not be charged for initial diagnostics.  A house call or site visit is NOT free and will be billed at current rates. L2 Innovate will attempt to diagnose your computer or peripheral problem, provide an estimate of applicable costs and service fees (plus applicable taxes), In certain cases, however, problem diagnosis and support may not be completed because of a problem with your computer, peripheral or its configuration that is beyond our control.

LIMITATIONS TO SERVICE: L2 INNOVATE RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED SERVICES AND INSTEAD REFUND YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY L2 INNOVATE.FORCE MAJEURE: If L2 Innovate's ability to render services is impaired by you or circumstances beyond the control of L2 Innovate, L2 Innovate may choose not to provide or to discontinue services. 


Backing up data before work is performed

 You understand and agree that prior to contacting or allowing L2 Innovate to perform diagnostics or other services on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that L2 Innovate shall not be responsible under any circumstance for any loss or corruption of data and/or software.

 

Limitation of Liability

To the extent permitted by law, you agree that L2 Innovate’s total liability for damages related to its services is limited to the total amount you pay for the services, and you release L2 Innovate and t’s employees from liability for any indirect, incidental, special, or consequential damages that you, the owner, or lessee may suffer. This includes but is not limited to data loss, corruption, or lack of function in any component or element of your computer equipment and/or peripherals as a result of L2 Innovate and/or its employees.

 

DMCA Violations

Distributing copyrighted materials without the consent of the owner is against federal law. If we receive notification that your computer equipment has been responsible for violating the Digital Millennium Copyright Act over our network. (Example: bit torrent transfer) You acknowledge that your identity may be revealed under provisions of the DMCA. You further acknowledge that you are responsible for all legal costs and/or damages assessed to L2 Innovate due to, or result of, the violation.

 

Finance Charges

A finance charge based on the market rate will be assessed if full payment is not received by L2 Innovate within thirty (30) days of the completed work.  The undersigned also agrees to pay L2 Innovate reasonable attorney’s fees and collection costs incurred in the collection of such indebtedness. It shall not be necessary for L2 Innovate, in order to enforce the obligations of the undersigned hereunder, to first institute suit or pursue or exalt it’s remedies against the undersigned.

 

Storage Charges

Equipment not picked up after thirty (30) days of the completed repair and/or repair estimate, will be subject to a storage charge of $1.00 per day.

 

Abandoned Equipment

Not withstanding any other provision of law, L2 Innovate shall take reasonable steps to contact the owner as shown in the records of L2 Innovate, to contact said owner of computer equipment, that it remains unclaimed and/or has outstanding charges after the completion of repair and/or repair estimate. If owner has not made arrangements and/or paid outstanding charges with L2 Innovate prior to (90) days following the completion of repair and/or repair estimate,  the computer equipment is presumed abandoned and will become the property of L2 Innovate and may be sold, or disposed of, as seen fit by L2 Innovate.

 

Replacing Components

Components that have been removed will not be returned unless arrangements have been made prior to the start of repairs.  An electronic waste disposal fee may be charged to cover recycling costs.

 

Software Installed by L2 Innovate

Acting as your agent on your behalf, software we install, may be subject to EULA or contract.  You are bound to the respective EULA or contract between you and the software company.  You acknowledge that  it is your responsibility to read through the software EULA or contract and if you disagree to it’s terms, discontinue it’s use and remove the software.  L2 Innovate does not check for licensing compliance for any software provided by you to be installed on your computer systems. It is the your responsibility to have proper licensing for any software provided. L2 Innovate reserves the right to refuse to install any software for which proper licensing cannot be demonstrated.

 

We do not provide telephone support unless contracted by special agreement.

The performance of services by L2 Innovate does not imply availability of technical support by telephone.
By preestablished agreement, we can access your computer remotely to provide certain services.
Each sevice call performed by this method will be billed in 15 minute increments.  Availablility is by appointment only.

15 Day Returns & Exchange Policy

Special ordered parts or equipment are not eligible.

On-Line Sales Must Request RMA Before Return.
Open Components Cannot be Returned.
Returns Subject to 15% Restocking Fee.
Defective Components Covered Under Manufacturer’s Warranty.
Open Software Cannot be Returned.
Un Serialized (CD Key) Defective Software Media Can be Exchanged 1 for 1.
Serialized Defective Software Media Covered Under Manufacturer’s Warranty.

Hard Drives Cannot be Returned or Exchanged.
Defective Hard Drives Covered Under Manufacturer’s Warranty.

PCs & Laptops Printers, LCDs, Networking & Streaming Equipment Cannot be Returned.
Defective PCs, Laptops, Printers, LCDs, Networking & Streaming Equipment is Covered Under Manufacturer’s Warranty.

Sales are Final on all Used & Refurbished items (sold as-is).

There is no Warranty on Used Laptop Batteries.

 

Deposits

Deposits are non-refundable for special orders and/or to hold merchandise.  Merchandise held by a deposit that has not been purchased within 30 days, will forfeit deposit unless a Layaway account has been opened.

 

Layaway

Layaway orders will only be accepted for orders valued above $200 US - Layaway duration is 60 days

Master Card, Visa, Discover, Debit, & Cash payments will be accepted for layaway orders. No Checks Will Be Accepted.
A minimum deposit of 30% is required at the time the layaway is placed.
Payments are due weekly by the same day as the commencement of the layaway.
A missed payment will place your Layaway account in default.
Layaway accounts in default will be subject to a 25$ Service Charge and a 20% restocking fee.

 

Warranty on Computer Equipment Repairs

L2 Innovate warrants that the computer equipment repairs performed by L2 Innovate will be free from defects in materials and/or workmanship when in normal use for a period of thirty (30) days from the date of purchase as determined by the date of the invoice with the following exception:  Defective CDs, DVDs, diskettes or other software media that are delivered with your computer equipment will be replaced by L2 Innovate or its suppliers for fifteen (15) days from the date you received your computer equipment.  L2 Innovate does not warrant any software, service, or consulting.  Use of software is subject to the terms and conditions of the software licensing agreement relating to such software. All support for software is provided by the respective manufacturer.  Warranty calls for software-related problems will be billed at an additional fee.

L2 Innovate does not warrant any form of data loss.  Data loss can result from many causes. These can include virus attacks,worms, spyware, trojans, system malfunction, or operator error.  L2 Innovate highly recommends that users take standard measures to protect their data, the most important of which are frequent and regular backups.

FORCE MAJEURE: If L2 Innovate's ability to render services is impaired by you or circumstances beyond the control of L2 Innovate, L2 Innovate may choose not to provide or to discontinue services.

LIMITATION OF LIABILITY: To the extent permitted by law, L2 Innovate’s total liability for damages related to its services is limited to the total amount you pay for the services, and you release L2 Innovate from liability for any indirect, incidental, special, or consequential damages. L2 INNOVATE IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.

 

L2 Innovate does not warrant damages or defects to the computer equipment under the following conditions: an Act of God, abuse, accident, or misuse of the computer products, unauthorized service or repair of the computer products, damage from electrical power problems, usage of parts or components not supplied by L2 Innovate, failure to follow product instructions and guidelines, unauthorized changes to the computer equipment, shipping damage (other than during original shipment from L2 Innovate), failure to perform preventative maintenance, or damage caused by peripherals or software or from other external causes.

 

L2 Innovate will, under the warranty period, repair or replace defective parts with new or remanufactured parts. The determination of when to use new and when to use remanufactured parts will be at the sole discretion of L2 Innovate. The repair or replacement of  computer equipment does not extend the warranty of said computer equipment.

THE WARRANTIES SET FORTH HEREIN ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE.  L2 INNOVATE DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE. EXCEPT FOR THE OBLIGATIONS SET FORTH IN THIS WARRANTY STATEMENT L2 INNOVATE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR LOSSES IN PROFITS, LOSSES IN REVENUE, LOSSES IN SAVINGS, LOSSES OF DATA, DOWNTIME, COSTS OF CAPITAL, COST OF REPLACEMENT EQUIPMENT (TEMPORARY OR PERMANENT), COSTS OF TIME, THIRD PARTIES' CLAIMS OR INJURY TO PROPERTY.

 

The limit of the liability of L2 Innovate to repair its computer equipment after a reasonable amount of time and a reasonable number of attempts, shall be the replacement of the computer parts or a refund of the original purchase price of the computer repair. The decision regarding replacement versus refund shall be at the sole discretion of L2 Innovate. The above options are the only remedies for any perceived breach of warranty by L2 Innovate.

 

Discounts & Specials

L2 innovate offers discounts and specials from time to time.   Only one discount or special can be used at a time and cannot be stacked or combined.  Specials and discounts are not available for commercial customers unless specifically offered and labeled for Business or Commercial customers.

L2 Innovate reserves the right to discontinue any discount or special at anytime.
